ChramKram is a brand operated by Ziemowit Fincek.
These Terms & Conditions (“Terms”) apply to all purchases made through the ChramKram online store.
By placing an order, you confirm that you have read and accepted these Terms.
These Terms apply primarily to consumer purchases within the European Union. Nothing in these Terms limits any mandatory rights granted to consumers under applicable EU or national law.
2. OUR PRODUCTS
ChramKram offers handmade, handcrafted and artisan products, including, but not limited to:
sculptures and decorative objects;
handmade accessories and jewellery;
leather goods;
wooden and natural-material products;
artistic and cultural objects;
prints and other artistic products;
other handmade products presented in the online store.
Many products are handmade or individually finished.
Because of this, individual products may vary slightly in:
colour;
texture;
shape;
dimensions;
surface;
natural grain;
finish.
Such variations are a natural characteristic of handmade production and are not automatically considered defects.
Product descriptions, photographs, dimensions and other information displayed on the product page form part of the product description.
3. PRODUCT PHOTOGRAPHS
We make reasonable efforts to present products accurately.
Colours may appear slightly different depending on the customer's screen, lighting and display settings.
For unique handmade products and original artworks, the actual physical item supplied may naturally differ slightly from photographs showing similar pieces.
Where a product is described as unique or one-of-a-kind, the customer will receive the specific item shown in the product listing unless otherwise stated.
4. ORDERS
Orders can be placed through the ChramKram online store.
Before submitting an order, the customer has the opportunity to review and correct the information entered.
By clicking the final order button, the customer places an order with an obligation to pay.
After placing an order, the customer will receive an order confirmation by email.
A contract of sale is concluded in accordance with the applicable law and the information provided during the checkout process.
We reserve the right to refuse or cancel an order for a legitimate reason, including:
the product being unavailable;
an obvious pricing or technical error;
suspected fraudulent activity;
an inability to fulfil the order;
circumstances outside our reasonable control.
If payment has already been received and we cancel an order, the amount paid for the cancelled order will be refunded.
5. PRICES
All prices are displayed in the currency indicated on the website.
Prices include applicable taxes where required by law.
Delivery charges are shown separately where applicable.
The total amount payable by the customer is displayed before the order is submitted.
Before concluding a distance contract, consumers must receive clear information about the product, seller, total price, applicable taxes, delivery costs and other required information.
6. PAYMENT
Available payment methods are displayed during checkout.
Payment must normally be completed before an order is processed.
Payments may be processed by third-party payment providers.
Where payment is processed by an external payment provider, ChramKram does not have access to the customer's full payment card details.
7. SHIPPING AND DELIVERY
We ship to the countries available at checkout.
Available delivery methods, delivery costs and estimated delivery times are displayed during the ordering process.
Estimated delivery times are estimates unless a specific delivery deadline has been expressly agreed.
The customer is responsible for providing a correct and complete delivery address.
If delivery fails because the customer provided an incorrect or incomplete address, additional delivery costs may apply where permitted by law.
For deliveries outside the European Union, the customer may be responsible for customs duties, import taxes and other charges imposed by the destination country.
For consumer purchases, mandatory statutory rules concerning delivery times and transfer of risk apply.
8. TRANSFER OF RISK
For consumer purchases, the risk of loss or damage to the goods normally remains with the seller until the goods are physically received by the consumer or a person designated by the consumer, unless mandatory applicable law provides otherwise.
9. RIGHT OF WITHDRAWAL — 14 DAYS
Consumers purchasing goods online within the European Union generally have the right to withdraw from the contract within 14 days without giving a reason. For goods, the period generally begins when the consumer or a person designated by the consumer receives the goods.
To exercise this right, the customer must inform us clearly of the decision to withdraw before the withdrawal period expires.

The customer may use the model withdrawal form included at the end of these Terms, but using the form is not mandatory.
10. RETURN OF GOODS
After notifying us of withdrawal, the customer must return the goods without undue delay and normally within 14 days of notifying us.
Unless applicable law requires otherwise, the customer is responsible for the direct cost of returning the goods when exercising the right of withdrawal, provided that the customer was properly informed of this before purchase.
The customer should package the returned product appropriately to prevent damage during transport.
The customer may be liable for a reduction in the value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
Mandatory consumer rights are not affected by this provision.
11. REFUNDS
When a valid right of withdrawal is exercised, we will refund the payments received from the customer, including the cost of standard delivery.
If the customer selected a more expensive delivery method than the cheapest standard delivery option offered by us, the additional cost does not have to be refunded where permitted by law.
We may withhold reimbursement until we have received the returned goods or the customer has provided evidence that the goods have been returned, whichever occurs first, where permitted by law.
Refunds will normally be made using the same payment method used for the original transaction, unless another method has been agreed.
Under EU consumer rules, refunds generally must be made within 14 days of receiving notice of withdrawal, subject to the statutory rules concerning receipt of the goods or proof of return.
12. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
The right of withdrawal does not apply where a statutory exception applies.
This may include goods that are:
Made to the consumer's specifications or clearly personalised, where the applicable law provides an exception.
Examples may include:
a commissioned artwork created to an individual's specifications;
personalised engraving;
an individually designed product;
a product made in a specific configuration requested by the customer.
This exception does not automatically apply simply because a product is handmade.
A standard, ready-made handmade product offered for general sale is not automatically excluded from the 14-day withdrawal right.
13. CUSTOM AND COMMISSIONED PRODUCTS
Before beginning a commissioned or personalised order, we may provide the customer with details concerning:
design;
dimensions;
materials;
colour;
finish;
price;
estimated production time.
Once production of a personalised product has begun, cancellation may not be possible where applicable law permits the statutory withdrawal exception described above.
If a commissioned product is defective or does not conform to the agreed specifications, the customer's statutory rights remain unaffected.
14. DAMAGED PACKAGES OR PRODUCTS
If an order arrives visibly damaged, the customer should, where reasonably possible, document the damage and contact us as soon as possible.
We may request:
the order number;
photographs of the product;
photographs of the packaging;
photographs of shipping labels;
a description of the damage.
Customers should retain the packaging until the matter has been resolved.
This procedure helps us investigate shipping damage and does not restrict any statutory consumer rights.
15. LEGAL GUARANTEE AND NON-CONFORMING GOODS
Consumers have statutory rights where goods are defective, damaged or do not conform to the contract.
EU consumer rules provide a minimum two-year legal guarantee for goods, with national laws potentially providing additional rights or longer protection.
Depending on the applicable law and circumstances, the consumer may have rights including:
repair;
replacement;
price reduction;
reimbursement/refund;
other remedies provided by applicable law.
These rights are independent of the voluntary return policy described above.

16. HANDMADE CHARACTER OF OUR PRODUCTS
Our products are created using handmade and artisan techniques.
Natural materials may contain characteristics such as:
variations in grain;
natural marks;
minor colour variations;
variations in texture;
small differences between individual pieces.
These characteristics may be inherent to the material and production process and do not necessarily constitute defects.
However, a product that is defective or does not conform to its description remains covered by applicable statutory rights.
17. PRODUCT SAFETY
Products must be used only for their intended purpose and in accordance with any product-specific instructions or warnings.
Where applicable, relevant safety information and warnings will be provided on the product page, packaging or accompanying documentation.
ChramKram complies with applicable EU product-safety requirements.
The EU General Product Safety Regulation (GPSR) has applied since December 2024 and establishes requirements for consumer product safety and information.
Where a particular product has specific safety instructions, those instructions should be followed.
18. PRODUCT CARE
Some handmade products require special care.
Care instructions may be provided on the product page or with the product.
Damage caused by:
misuse;
neglect;
improper storage;
improper maintenance;
accidental damage;
use contrary to supplied instructions;
may not constitute a lack of conformity.
Nothing in this section excludes or limits mandatory statutory rights.
19. INTELLECTUAL PROPERTY
All intellectual property displayed on the ChramKram website belongs to the respective rights holder unless otherwise stated.
This includes:
photographs;
artwork;
designs;
illustrations;
text;
logos;
trademarks;
graphics;
videos;
original artistic works.
Purchasing a physical product does not transfer copyright or other intellectual property rights unless expressly agreed in writing.
A customer who purchases an artwork or handmade object may own the physical object but does not automatically acquire the right to reproduce, copy, commercially exploit or distribute the underlying artwork or design.
20. ORIGINAL ARTWORKS
Where a product is described as an original artwork, the physical original artwork is the item being sold.
Unless expressly agreed otherwise, the purchase does not transfer:
copyright;
reproduction rights;
commercial licensing rights;
permission to reproduce the artwork.
21. CUSTOMER REVIEWS AND CONTENT
Where customers can submit reviews, photographs, comments or other content, such content must not:
be unlawful;
contain threats or harassment;
infringe intellectual property rights;
violate another person's privacy;
contain malicious software;
contain knowingly false or fraudulent information.
We reserve the right to remove content that violates applicable law or these Terms.
22. PRIVACY AND PERSONAL DATA
We process personal data in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR) where applicable.

23. WEBSITE AVAILABILITY
We make reasonable efforts to keep the website available and operational.
Temporary interruptions may occur due to:
maintenance;
technical problems;
hosting issues;
software updates;
cybersecurity incidents;
circumstances beyond our reasonable control.
We may modify or temporarily suspend parts of the website where reasonably necessary.
24. ERRORS
We make reasonable efforts to ensure that product descriptions, prices and other information are accurate.
If an obvious technical, typographical or pricing error occurs, we reserve the right to correct it.
If an obvious error materially affects an order that has already been placed, we will contact the customer and apply the remedies required by applicable law.
25. FORCE MAJEURE
We are not responsible for delays or failure to perform obligations caused by circumstances beyond our reasonable control, including natural disasters, war, government restrictions, widespread technical failures, strikes, transport disruptions or other force majeure events.
This does not affect mandatory consumer rights.
26. BUSINESS CUSTOMERS
These Terms primarily concern consumer purchases.
Businesses purchasing products may contact us regarding:
wholesale orders;
commercial projects;
larger quantities;
custom production;
invoices;
separate commercial terms.
Separate written terms may apply to business-to-business transactions.
27. CHANGES TO THESE TERMS
We may update these Terms from time to time.
The version applicable to an order is the version available on the website when the order is placed, unless a later change is required by applicable law.
The date of the latest update appears at the beginning of these Terms.
28. GOVERNING LAW
These Terms are governed by the laws of Poland, without prejudice to mandatory consumer protection provisions that apply in the consumer's country of residence.
Nothing in these Terms prevents a consumer from relying on mandatory rights provided by applicable EU or national law.
29. COMPLAINTS AND DISPUTE RESOLUTION
We encourage customers to contact us first so that we can attempt to resolve any complaint directly.
